ADVERTISING & PROMOTIONS TERMS AND CONDITIONS
Effective Date: April 6, 2026
Last Revised: October 15, 2026
These Advertising & Promotions Terms and Conditions ("Promotion Terms") apply to advertisements, sponsored social-media content, limited-time offers, discounts, vouchers, packages, contests, referral offers, memberships, email and SMS promotions, and other promotional communications issued by Aevua Medical Spa ("Aevua," "we," "us," or "our"), at 449 W Mt Pleasant Ave, Suite 1, Livingston, NJ 07039.
IMPORTANT: AN ADVERTISEMENT IS AN INVITATION TO LEARN MORE, NOT MEDICAL ADVICE OR A GUARANTEE OF CLINICAL ELIGIBILITY OR RESULTS. INDIVIDUAL RESULTS AND RISKS VARY. A CLINICAL CONSULTATION AND INFORMED CONSENT MAY BE REQUIRED BEFORE TREATMENT.
HOW THESE TERMS APPLY
1.1 These Promotion Terms supplement Aevua's website Terms & Conditions, Privacy Policy, booking policies, refund and cancellation policy, membership terms, and treatment-specific informed-consent documents.
1.2 The specific written terms displayed in an advertisement, landing page, voucher, checkout, enrollment form, or confirmation govern that offer. If specific offer terms conflict with these general Promotion Terms, the specific offer terms control for that offer, except where prohibited by law.
1.3 Viewing or clicking an advertisement alone does not create a patient-provider relationship, guarantee treatment, or by itself constitute acceptance of a contract. A purchase, booking, or enrollment is governed by the terms disclosed at that transaction and any required affirmative consent.
MATERIAL OFFER TERMS
2.1 Every offer is subject to the price, included services, eligibility, geographic availability, redemption window, expiration date, quantity limit, and exclusions stated in that offer. A promotion applies only to the specific service, session, treatment area, quantity, duration, location, and dates expressly identified. It does not apply to additional or future sessions, add-ons, packages, memberships, prior purchases, existing appointments, or outstanding balances unless the offer expressly states otherwise. Aevua must clearly disclose material restrictions and mandatory costs before purchase; a general link to these terms does not cure a misleading advertisement. Contact us for clarification before purchase.
2.2 Unless an offer expressly states otherwise, it is available only to new Aevua clients and is limited to one redemption per client. A “new client” is a person who has not previously received a paid or promotional service from Aevua and has not previously purchased an Aevua package or membership. Aevua may verify eligibility using its client records before booking or redemption. Promotions are non-transferable, not redeemable for cash, cannot be combined with another promotion, membership discount, loyalty redemption, manufacturer rebate, or package price, and remain subject to appointment availability and clinical eligibility.
2.3 A stated "regular," "original," "usual," or comparison price refers to Aevua's bona fide standard price for the same service or package. Percentage or dollar savings are calculated against that stated comparison price. Taxes, prescription costs, laboratory fees, products, maintenance treatments, or add-ons are included only when expressly stated.
2.4 Claims such as "limited," "only X remaining," "first X clients," or an expiration date apply only when the limitation is genuine and tracked. An offer may close when the stated quantity is exhausted or the stated deadline passes. Aevua will not use artificial scarcity to extend or recreate an expired limitation.
2.5 Aevua may correct a genuine typographical or system error before purchase. If a material error is discovered after payment, Aevua will offer the advertised transaction where legally required or allow cancellation with a refund of the amount paid for the affected, unperformed service.
REDEMPTION AND CLINICAL ELIGIBILITY
3.1 Promotions may be redeemed only through the method identified in the offer. Claiming a voucher or submitting an inquiry does not reserve an appointment or guarantee treatment.
3.2 A consultation, medical history, examination, testing, prescription, or medical clearance may be required. A licensed provider may decline, postpone, or modify treatment when clinically appropriate.
3.3 If Aevua determines before treatment that a prepaid promoted service is medically inappropriate, Aevua will offer an appropriate substitute accepted by the client or refund the unused amount paid for that service, except where another remedy is required by law.
3.4 Clients must provide complete and accurate health, medication, allergy, pregnancy, and prior-procedure information and follow all pre- and post-treatment instructions.
LASER HAIR REMOVAL OFFERS
4.1 "Unlimited" laser hair removal means no separate per-session charge for eligible sessions during the period and for the treatment areas expressly stated in the offer. It does not mean treatment on demand or an unlimited number of clinically unnecessary sessions.
4.2 Sessions are scheduled at clinically appropriate intervals based on the treatment area, hair-growth cycle, skin response, device protocol, provider judgment, and appointment availability. A twelve-month offer begins on the start date stated at purchase or, if none is stated, the date of the first completed treatment.
4.3 Selected treatment areas and permitted area combinations are those shown in the specific offer and are confirmed at consultation. Areas may not be substituted after treatment begins unless Aevua agrees in writing.
4.4 Laser treatment provides hair reduction, not guaranteed permanent removal. Regrowth and maintenance treatments may occur due to hormones, age, medication, medical conditions, or individual biology.
WEIGHT-LOSS, BODY-CONTOURING, IV, INJECTABLE, AND WELLNESS OFFERS
5.1 Weight-loss and wellness promotions are subject to medical evaluation and are not guarantees of a specific number of pounds, inches, treatment sessions, medication eligibility, or timeframe. Generally expected results, material program requirements, and all mandatory costs must be disclosed in the specific offer or before enrollment.
5.2 Prescription medication is provided only when prescribed by an appropriately licensed clinician. Medication, laboratory work, supplies, follow-up visits, and maintenance are included only when expressly stated.
5.3 Body-contouring, injectable, laser, IV, and other aesthetic or wellness procedures involve risks and may not be suitable for every person. Device clearance or product approval does not mean that every advertised use, person, or outcome is FDA-approved or guaranteed.
RESULTS, TESTIMONIALS, REVIEWS, AND IMAGES
6.1 Before-and-after images and testimonials depict individual experiences. Aevua will not present exceptional results as typical without a clear disclosure of the results clients generally can expect under comparable circumstances.
6.2 Results vary with age, anatomy, skin and hair characteristics, health history, hormones, lifestyle, adherence, treatment area, number of sessions, and other factors. No outcome is guaranteed.
6.3 Images may be cropped or resized for presentation or privacy, but edits, lighting and presentation must not misrepresent treatment results. Simulated, stock, or illustrative images will be identified where their context could otherwise imply an actual Aevua client result.
6.4 Any material connection between Aevua and an endorser—including payment, free or discounted services, employment, ownership, family relationship, gifts, or contest entries—must be clearly and conspicuously disclosed in the endorsement itself.
SOCIAL MEDIA, INFLUENCERS, CONTESTS, AND PLATFORM DISCLAIMERS
7.1 A sponsored or incentivized social-media post must include an unavoidable disclosure such as "Ad," "Sponsored," or another clear statement of the relationship, placed where viewers will see or hear it with the endorsement.
7.2 A contest or giveaway is governed by separate official rules stating eligibility, entry period, prize, approximate retail value, selection method, odds statement where appropriate, sponsor, and any platform-required release. A chance-based promotional sweepstakes must provide a genuine no-purchase entry method and cannot require payment or treatment to enter or win. Any skill contest requires its own lawful rules.
7.3 Promotions advertised or sold through Meta, Facebook, Instagram, Google, Groupon, TikTok, YouTube, email, SMS, or any other third-party platform remain subject to the eligibility and use restrictions in these Promotion Terms unless the specific offer expressly states otherwise. Platform-specific terms presented at purchase also apply. Aevua will not apply these terms retroactively or inconsistently with the offer as presented at purchase or with non-waivable law. Unless another sponsor is expressly identified, the promotion is sponsored by Aevua; the platform does not sponsor, endorse, administer, or assume responsibility for it.
BOOKING, PAYMENT, CANCELLATIONS, AND REFUNDS
8.1 Prices are in U.S. dollars. Payment timing, deposits, recurring charges, financing, and cancellation terms must be disclosed before the client completes the applicable transaction.
8.2 A $40 deposit is required to reserve every appointment and is applied toward the scheduled service price when the appointment is completed. Appointments must be canceled or rescheduled at least forty-eight (48) hours before the scheduled time. Changes made with less than forty-eight (48) hours’ notice incur a fee equal to fifty percent (50%) of the scheduled service’s full retail price. A no-show results in forfeiture of the $40 deposit and a separate fee equal to fifty percent (50%) of the scheduled service’s full retail price. These fees are based on the regular retail price before any promotion, discount, voucher, membership benefit, or credit and may be charged to the authorized payment method on file. The policy presented during booking and Aevua’s posted Appointment & Booking Policy also apply, subject to applicable law.
8.3 Refunds for performed services, unused prepaid services, products, packages, memberships, and clinically unsuitable services are governed by the applicable written policy and non-waivable law. Nothing in these Promotion Terms eliminates rights or remedies that cannot legally be waived.
MARKETING COMMUNICATIONS AND PRIVACY
9.1 Submitting an inquiry or voucher form authorizes Aevua to respond to that request using the contact information provided. It does not, by itself, constitute consent to unrelated automated marketing calls or texts.
9.2 Marketing email or SMS consent must be obtained through the disclosure and affirmative action presented at the point of collection when required by law. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out of SMS and HELP for assistance. Email recipients may use the unsubscribe link or contact Aevua.
9.3 Personal information is handled under Aevua's Privacy Policy. Do not submit medical or other sensitive information through an advertising lead form unless the form expressly states that it is appropriate for that purpose.
CHANGES AND AVAILABILITY
10.1 Aevua may withdraw a promotion prospectively, subject to law and any rights already acquired through a completed purchase. A material change will not retroactively reduce a paid benefit without an appropriate remedy.
10.2 Updates to these Promotion Terms apply prospectively from the posted revision date. Terms presented and accepted for a completed transaction remain applicable to that transaction unless both parties agree otherwise or a change is required by law.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Aevua is not liable for indirect or consequential damages arising solely from participation in a promotion. This limitation does not exclude liability or consumer rights that cannot legally be excluded, including liability arising from professional negligence, willful misconduct, fraud, deceptive practices, or other non-waivable obligations.
GOVERNING LAW
These Promotion Terms are governed by New Jersey law, without limiting any non-waivable consumer protection. Before filing a dispute, either party may request informal resolution by contacting contact@aevua.com. Nothing here prevents a person from contacting a regulator, filing an eligible small-claims matter, or exercising another non-waivable right.

NEUROMODULATOR OFFERS — Updated October 12, 2026
Offers for neuromodulator injections, including BOTOX Cosmetic and Dysport, must identify the specific product, included units or treatment scope, total price or pricing basis, and any additional mandatory costs. Units of different botulinum toxin products are not interchangeable; a unit-price comparison alone does not establish equivalent treatment or value.
Prescription treatment requires an individual clinical assessment and informed consent. An offer does not guarantee suitability, same-day treatment, a particular result, or a fixed duration of effect. Additional injections, follow-up services, and manufacturer or membership benefits are included only as stated in the applicable offer or agreement. The clinical eligibility and prepaid-service remedies above continue to apply.
Patient permission and annual forms
Advertising use of identifiable patient images, videos or testimonials requires the separate voluntary authorization specifying the material, channels and expiration. Our current Photo & Testimonial Release expires one year after signing unless a shorter period is recorded; it may be revoked in writing prospectively, subject to lawful prior reliance. A tag, inquiry, purchase or treatment consent is not publicity permission. Clinical forms are ordinarily renewed annually, with visit-specific checks and additional consent when materially necessary. Incentives must be disclosed and cannot be conditioned on a positive review.
Existing written membership or promotional booking exceptions remain effective. Staff review and manually process applicable missed-appointment fees; a general advertisement does not authorize an undisclosed charge.
