Terms & Conditions
Updated October 15, 2026
These terms explain use of Aevua Medical Spa's website and the relationship between our booking, purchase, membership and clinical documents. Contact: (973) 313-5601, contact@aevua.com, 449 W Mt Pleasant Ave, Suite 1, Livingston, NJ 07039.
How the documents work together
The terms clearly disclosed and accepted for your particular purchase or enrollment govern that transaction, together with applicable law. Our Appointment & Booking Policy, Refund & Cancellation Policy, Membership Terms & Conditions, Advertisement Terms & Conditions, Shipping Policy and Privacy Policy provide the relevant details. These updated website terms do not retroactively reduce a purchased benefit, increase an agreed fee, remove a promised refund, or replace an existing signed agreement. Where published descriptions conflict, ask us to confirm your actual enrollment or purchase terms in writing before paying; we will honor applicable law and your existing contractual rights.
Browsing, submitting an inquiry or booking a consultation does not by itself authorize treatment, recurring charges, marketing messages, public photography, arbitration, or a waiver of legal rights. Those matters require the applicable separate disclosures and affirmative agreement. Website updates apply prospectively with any additional notice or consent required by law.
Medical information, assessment and consent
Website articles, quizzes, advertisements and before-and-after photographs provide general information. They do not replace individual assessment, diagnosis or advice. A booking or payment does not guarantee clinical eligibility or same-day treatment. The treating professional must work within their actual license, qualifications, lawful scope, prescribing authority and any required supervision or collaboration. A staff title, device model, consent form or website statement is not proof of permission to perform a procedure.
Before a procedure, the treating professional discusses the proposed treatment, expected benefits, material risks, reasonable alternatives including no treatment, anticipated recovery, cost and any proposed off-label use. Prescription products, exact doses and treatment settings are determined through a valid clinical assessment and order. Product approvals and device clearances are specific; they do not approve every use or guarantee results. Compounded drugs are not FDA-approved finished products. Units of different neuromodulators are not interchangeable.
Patient forms are renewed annually, generally every 12 months. At each visit, staff must confirm relevant changes, the current plan and the patient's willingness to proceed and document the encounter. A full annual form need not be repeated at every appointment. A material change in treatment, risk, health status or other legally required circumstance may require an updated discussion or specific consent sooner. Patients may ask questions, decline or stop a procedure, and withdraw consent for future treatment. Annual consent does not authorize unrelated procedures or treatment after withdrawal.
Provide accurate health, medication, allergy, pregnancy and prior-treatment information, and report changes. Follow individualized preparation and aftercare instructions. Do not stop a prescribed medication without the prescribing clinician's guidance. Disclosures and aftercare responsibilities do not waive a patient's rights or excuse a provider's standard of care. No aesthetic outcome, duration or absence of complications is guaranteed. Consent to a known risk is not consent to negligent care.
Minors and representatives
Elective services for minors require advance review of service eligibility, capacity, legal authority and applicable consent and confidentiality rules. We verify a representative's authority and seek the minor's assent where appropriate. A guardian's signature does not authorize every procedure or override a minor's statutory rights. Ask before booking a minor; adult-only treatments remain subject to our clinical restrictions.
Appointments and fees
A $40 appointment deposit is applied toward the scheduled service when completed. At least 48 hours' notice is required to cancel or reschedule. The standard late-cancellation fee is 50% of the scheduled service's full retail price before discounts or credits. A no-show incurs the separate 50% fee plus forfeiture of the $40 deposit. No-show includes cancellation less than two hours before the appointment or arrival more than 15 minutes late when safe, adequate treatment cannot be completed. Staff review and process applicable fees manually using an authorized payment method; Mangomint does not automatically charge them.
Call (973) 313-5601 or email contact@aevua.com to cancel; voicemail and email timestamps determine timeliness. SMS is not accepted as official cancellation notice. A functioning portal cancellation may also be used where offered and confirmed. Disclosed written membership or promotional exceptions remain applicable. Fees and deposit handling must be explained before booking and cannot exceed the agreed, lawful terms. Clinically necessary postponement, emergencies and accommodation requests receive individual review. We do not perform unsafe treatment to avoid a cancellation.
Payments and purchases
Payment is ordinarily due when services or products are provided unless a different written arrangement applies. Before agreeing, confirm the product or service, total price, units or quantity, included follow-up, taxes and any additional charges. A stored card does not authorize undisclosed charges. Financing is subject to the financing provider's separately accepted terms. HSA/FSA eligibility depends on the service and plan; cosmetic treatment is not automatically eligible.
Any credit-card surcharge must be disclosed before payment and cannot exceed actual processing cost or the applicable legal and network limit, whichever is lower. We do not add credit-card surcharges to debit-card payments. Tax treatment follows the applicable product or service rules. Pricing corrections do not authorize undisclosed retroactive charges. If an unperformed prepaid service cannot be supplied as agreed or is determined medically unsuitable, we offer a client-accepted appropriate alternative or refund the unused amount, subject to any stronger legal rights.
Refunds, memberships and disputes
The separate refund policy explains ordinary return windows and assessment options. Lack of a guaranteed result does not eliminate remedies for negligent care, defective goods, misleading claims, billing errors or undelivered services. Good-faith chargebacks and payment-provider disputes are not prohibited; contacting us is encouraged but is not a condition of exercising those rights.
Membership requires affirmative enrollment and recurring-payment authorization after disclosure of the amount, frequency, renewal, minimum term, cancellation method and any lawful fee. Current public plans and legacy benefits are described in the membership page and individual enrollment agreement. Existing founding benefits remain governed by the actual accepted agreement; these website revisions do not revoke them. A membership never guarantees medical eligibility or replaces consent. We do not impose a new minimum term, early-termination charge, retroactive discount recapture or forfeiture through a website update. Purchased gift-card value and other protected prepaid funds retain applicable legal protections.
Clinical records, privacy and photographs
Our Privacy Policy includes the full Notice of Privacy Practices. Receipt acknowledgment is optional and is not authorization for extra disclosures, marketing or public photographs. Clinical documentation is distinct from publicity. Public use of identifiable photographs, videos or testimonials requires the separate, voluntary Photo & Testimonial Release specifying the material, permitted channels and expiration. Our current form expires one year after signature unless a shorter period is recorded. Written revocation stops future authorized use, subject to actions already taken in lawful reliance and any applicable rights. A post, tag, email, review, treatment booking or general website agreement does not grant a perpetual license to use a patient's identity or medical information.
We may display a review submitted expressly for publication in the context authorized by its submission and applicable law. We do not claim ownership of a customer's review, restrict honest reviews, or require a positive review. Material incentives must be disclosed. Additional advertising reuse of identifiable patient information requires the relevant permission. Limited cropping or sizing must not distort results.
Email, telephone and SMS
Care and account communications follow your applicable preferences. Optional marketing consent is separate and is not a condition of purchase or care. Automated marketing texts are sent only with the consent required by law. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for assistance, or contact us. We honor reasonable revocation requests within applicable deadlines. Ordinary texts and email can be viewed by others and are not emergency channels. Selecting them does not waive our privacy duties. We do not share mobile opt-in information with third parties for their own marketing.
Access, accommodations and conduct
We welcome accommodation requests and aim to provide effective communication and access as required by law. Advance notice helps but is not an absolute condition of accommodation. Guests in clinical areas are managed with patient permission, privacy and safety in mind; HIPAA does not categorically prohibit support people. Service-animal requests are assessed under applicable law, not a blanket treatment-room exclusion. See the Accessibility Statement and contact us for assistance.
We may restrict abusive, threatening, unlawful or unsafe conduct and unauthorized system access. Ending an appointment, membership or online account does not eliminate record-access rights, required follow-up, lawful refunds, or professional obligations concerning continuity of care and patient abandonment. We will handle any clinical relationship termination in accordance with those duties.
Website use and intellectual property
Use the website lawfully. Do not impersonate others, introduce malicious code, bypass access controls or misuse another person's account or information. Protect your login and promptly report suspected unauthorized access. Aevua and its licensors retain their rights in original website content and branding. You may view and print information for personal use and exercise rights otherwise allowed by law. These terms do not claim exclusive rights over general medical knowledge or restrict lawful criticism. Contact us about suspected infringement; identify the material and your basis for the request.
Third-party services and product information
External sites and payment, booking or other providers have their own terms and practices. Links do not guarantee their accuracy or availability. Aevua remains responsible for obligations that apply to its own conduct and vendors. Follow product labeling and individualized clinical guidance. “Medical grade” is not a general FDA approval category. Do not assume redness, burning or a new eruption is harmless “purging.” Stop a product and seek advice for concerning reactions; get emergency help for breathing difficulty or severe swelling. Pregnancy and breastfeeding advice depends on the specific ingredient and exposure.
Rights, responsibility and resolution
These terms do not release professional negligence, impose a $500 or purchase-price cap on patient claims, disclaim legally required product warranties, make patients indemnify Aevua for its own conduct, or waive privacy, consumer, discrimination or other protected rights. Website availability and treatment outcomes cannot be guaranteed, but applicable duties and remedies remain enforceable. No arbitration agreement or class-action waiver is created simply by visiting this website. Any separately proposed dispute agreement must receive its own legally sufficient disclosure and assent.
New Jersey law applies where legally appropriate, without displacing nonwaivable protections. You may contact us to resolve a concern, contact a regulator, use payment-provider remedies, or pursue a claim in a court with jurisdiction. Informal discussion is not a prerequisite to urgent relief and does not shorten a filing deadline. If a provision is unenforceable, remaining lawful provisions continue without expanding the invalid provision.
Urgent concerns
For an emergency, call 911 or go to the nearest emergency department. For non-emergency treatment concerns, call (973) 313-5601. Do not wait for a reply to email or SMS when urgent care is needed. After botulinum toxin treatment, trouble swallowing, speaking or breathing requires immediate medical attention. After filler, visual changes, unusual severe pain or skin color changes need urgent assessment. Routine correction-assessment windows never limit access to medically necessary evaluation.
